Sure it's a skirt. Miniskirts are tight enough that in order to even spread your legs this far, you'd need to pull them up almost to your hips, and they'll look like that. This does make the upskirt tag a bit questionable, though.

Well, the skirt is up. So it's upskirt, but not as we know it.
