There is a difference, and a rather important one at that. Sayaka changed into a witch, and thus she is now dead since even with new rules she was beyond salvation. Kyouko, on the other hand, died in a suicide attack against a witch, and thus now that there are no witches, she had no need to do it and in effect is alive.

That's incorrect... If you remember just after the scene in ep 12 where Madoka and Sayaka were watching Kyosuke's audition, just after that scene, the remaining girls just fought a demon. Sayaka sacrificed herself in the process. So in Madoka's rework, Sayaka is (or was) alive at that point.
